The ClothSmith is an India-based online apparel store offering made-to-order clothing. Our fulfillment and shipping services are provided through third-party vendors, such as Qikink.
By using our Site, you confirm that you are at least 18 years of age or are accessing the Site under the supervision of a parent or legal guardian.
2. Use of the Website
You agree not to:
- Violate any laws, third-party rights, or our policies.
- Use bots, data mining, or scraping tools on our platform.
- Upload harmful or misleading content.
- Disrupt the functionality or security of our website.
We reserve the right to terminate your access or ban your account for violations of these Terms.
3. Products and Orders
- All products on our store are made-to-order and may have slight variations in color or print quality.
- Prices and availability are subject to change without prior notice.
- Orders will be confirmed via email once payment is successfully processed.
- We reserve the right to cancel any order due to pricing errors, stock issues, or suspicious activity.
4. Shipping and Delivery
- We currently deliver across India through our partner Qikink. Orders are usually dispatched within 2–4 business days and delivered within 5–10 business days depending on your location. Tracking details will be provided once the order is shipped. Delays due to external factors (weather, strikes, or courier delays) are not our responsibility, and no refunds or cancellations will be provided solely on the basis of such delays.
5. Returns and Refunds
- Since products are made-to-order, we only accept returns or exchanges in the case of:
1.Wrong item received.
2.Defective or damaged product.
3.Incorrect size sent (if different from what was ordered). - Please note that if the size ordered by the customer was incorrect (i.e., the size received matches the size ordered, but the customer wishes a different size), this does not qualify for a return or exchange.
Customers are required to provide clear photographic or video evidence of the wrong, defective, or damaged product to facilitate the return verification process. - Refunds, if applicable, are processed within 5–7 business days after return verification. Refunds will be issued to the original payment method used for the purchase.
- For valid returns based on the conditions above, The ClothSmith will cover the cost of return shipping.

6. Payment Terms
- We accept payments via Razorpay, UPI, and other secure methods.
- All prices listed are in INR and inclusive of applicable GST.
- We do not store your credit card, UPI, or bank details.
7. Account and Security
- You are responsible for maintaining the confidentiality of your account and password.
- We are not liable for unauthorized use of your account.
- Please notify us immediately if you suspect a breach of security.
8. Intellectual Property
- The content on this Site, including our logos, text, graphics, and the overall design and compilation of the website, are owned by or licensed to The ClothSmith and are protected by intellectual property laws.
- The ClothSmith also respects the intellectual property rights of others. If you believe that any content, including product designs or imagery, on our Site infringes upon your copyright or trademark, please notify us immediately with the following information:
- a. A description of the copyrighted work or trademark that you claim has been infringed;
- b. A description of the material on our Site that you claim is infringing, with enough detail to locate it on the Site;
- c. Your contact information, including your name, address, telephone number, and email address;
- d. A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright or trademark owner, its agent, or the law;
- e. A statement by you that the information in your notice is accurate and that you are the copyright or trademark owner or authorized to act on the copyright or trademark owner’s behalf.

9. Limitation of Liability
To the fullest extent permitted by law:
- The ClothSmith shall not be liable for any indirect, incidental, or consequential damages.
- We are not responsible for product misuse, allergies, or external courier mishandling.
- Our total liability under any circumstances is limited to the amount paid for the product.

11. Force Majeure
We shall not be held liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, lockdowns, or interruptions in internet service.

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Ghaziabad, Uttar Pradesh.
